Terms of Service
In short
- Sixty is paid monthly by card (Yoco) or EFT. No contract, and a full refund within 30 days of your first payment.
- Only message people who contacted you, and stop when they ask.
- Check your listings and messages. You're responsible for what's sent in your name.
- Your data is yours: export it any time, and close your account whenever you like.
01This agreement
These terms are the agreement between you and Sixty ("we", "us") for using the Sixty app. By creating an account or using Sixty, you agree to them. If you sign up on behalf of an agency or company, you confirm you're allowed to agree for it.
Our Privacy Policy explains how we handle personal information and forms part of these terms.
02What Sixty does
Sixty helps estate agents answer enquiries quickly. Using your settings, it writes and sends replies and follow-ups, alerts you when a lead needs you, lets leads book viewings, and helps with listings, seller reports and check-ins with past clients.
Sixty is a tool. You stay the agent: you're responsible for your clients, your advice and what's sent in your name.
03Your account
- You must be at least 18 and give accurate details.
- Each account is for one person. Keep your password private and tell us straight away if you think someone else has used it.
- Where the law requires it, you must be registered to work as an estate agent. In South Africa, that means holding a valid Fidelity Fund Certificate from the Property Practitioners Regulatory Authority (PPRA).
04Using Sixty responsibly
You agree to:
- Only use Sixty to contact people who contacted you first, or with whom you have a lawful relationship, and to respect anyone who asks you to stop.
- Follow the laws that apply to you, including, in South Africa, the Protection of Personal Information Act (POPIA), the Consumer Protection Act, the Electronic Communications and Transactions Act and the Property Practitioners Act.
- Follow the rules of property portals and of Google, Microsoft and Meta (WhatsApp) for any account you connect.
- Only import contacts and add listings you have the right to use.
You agree not to:
- send spam, or misleading, unlawful or discriminatory messages;
- use Sixty for anything other than real property enquiries and client care;
- try to break, overload, copy or reverse-engineer Sixty, or get into other people's accounts;
- resell or share access to Sixty.
05AI-written messages
Sixty uses AI to write messages in your voice and to fill in listing details. We build in safeguards, but AI can still get things wrong, for example a price, a property detail or a date.
06Your data
Your leads, listings, contacts and messages belong to you (or your agency). You allow us to store and process them only to run Sixty for you. You can export your leads and conversations at any time from Settings.
You're responsible for having a lawful reason to hold the personal information you put into Sixty. We handle it on your behalf as described in our Privacy Policy, keep it secure, and tell you if a security breach affects it.
07Plans and fees
Sixty is a paid plan: Sixty, or Sixty Pro with extra features, billed monthly or yearly. Prices are in South African rand and are shown before you pay.
- You pay monthly or yearly in advance, by card through our payment provider Yoco (or by EFT if we've agreed that with you). The yearly price is 25% less than paying monthly for 12 months.
- First-month offer: your first monthly payment is R99 for Sixty or R299 for Sixty Pro. Every month after that is the normal price, shown before you pay. The offer is for monthly plans only, once per agent, and a first-month payment doesn't count towards becoming a founding agent. We may end the offer for new sign-ups at any time.
- There are no debit orders: you renew yourself, and we remind you before your paid month or year ends. Paying early adds the new month or year to the end of your current one.
- If you don't renew, your access continues until the end of the month or year you've paid for. After that Sixty stops answering and following up on new leads, but you can still log in to export your data.
- If Sixty isn't for you, ask for a full refund within 30 days of your first payment, whether it was monthly or yearly.
- There's no contract and no cancellation fee. You can stop any time.
- If we change our prices, the new price applies from your next payment and is shown before you pay (unless you're a founding agent, below).
08Founding agent price lock
- The first 20 agents whose first full-price payment we receive become founding agents. Free accounts, test payments and refer-only partner accounts don't count.
- As a founding agent, the price you paid for your plan (monthly or yearly) never goes up for as long as your subscription stays active. If you upgrade or switch to yearly, that plan is locked at the price that applies on the day you switch.
- Your subscription stays active if you renew no later than 14 days after your paid month or year ends. If you cancel or don't renew in that time and come back later, normal pricing applies.
- The price lock is personal to your account and can't be transferred.
09Other services Sixty relies on
Sixty works with services we don't control, such as Google, Microsoft, WhatsApp, mobile networks and property portals. Their own terms apply when you connect them, and we're not responsible for their outages, changes or decisions (for example, if WhatsApp doesn't approve a message template). Until your WhatsApp number is connected for automatic sending, Sixty prepares WhatsApp and SMS messages for you to send with one tap.
10Availability and changes
We work to keep Sixty running and replying around the clock, but we can't promise it will never be interrupted, and messages can sometimes be delayed or fail. Check important conversations yourself. We keep improving Sixty and may add, change or remove features. If we remove something important you pay for, we'll tell you first.
11Ending your account
You can stop using Sixty at any time. To close your account and delete your data, email support@officialsixty.com.
We may suspend or close an account that breaks these terms, causes spam complaints, or puts other people or Sixty at legal risk. Where it's reasonable, we'll warn you first and give you a chance to export your data.
12Our responsibility to you
Sixty is provided "as is". To the extent the law allows, we don't promise it will suit every purpose or be free of errors.
To the extent the law allows, we're not liable for indirect or consequential losses, such as lost commission, lost deals or lost profit. Our total liability to you is limited to the fees you paid us in the 12 months before the claim, or R1 000 if you haven't paid anything.
These limits don't apply to loss caused by our gross negligence or deliberate wrongdoing. Nothing in these terms takes away rights you have under the Consumer Protection Act or any other law that can't be excluded.
You agree to cover us against claims from others that arise from messages you send through Sixty or from your breaking these terms or the law.
13Changes to these terms
We may update these terms. We'll change the date at the top and, for important changes, email you at least 14 days before they take effect. If you keep using Sixty after that, the new terms apply. If you don't agree, you can close your account.
14Law and disputes
These terms are governed by the laws of the Republic of South Africa, and South African courts can hear any dispute. If something goes wrong, please email support@officialsixty.com first. Most problems can be fixed quickly that way.
